Missouri state Sen. Eric Burlison (R-Battlefield) is pushing legislation to protect Second Amendment rights in the state by nullifying any gun control measures President Joe Biden might enact.


KMOX News Radio 1220 reports that Burlison’s legislation, Senate Bill 39, titled, “Second Amendment Protection Act.”

Missourinet noted that Burlison told fellow lawmakers the Act is designed to prevent in-state enforcement of “gun bans directly, magazine bans, attacks on private gun manufacturers, red flag laws, and restrictions on individual citizens from buying firearms.”


The Act declares “that federal supremacy does not apply to federal laws that restrict or prohibit the manufacture, ownership, and use of firearms, firearm accessories, or ammunition within the state because such laws exceed the scope of the federal government’s authority.”


It says that “no public officer or state or local employee has the authority to enforce firearms laws declared invalid by the act,” adding: “Any public officer or state or local employee who tries to enforce the firearms law declared invalid by the act or any person who acts under the color of law to deprive a Missouri citizen of rights or privileges ensured by the federal and state constitutions shall be liable for redress.”

 
As it should be, If the Communists running the federal government want to enact laws, then they are the ones that should enforce them. Be aware though, these shit heads will use the purse to empower the states to do their bidding.
 
Didn't we already have states try this several years ago??? Didn't the courts tell them that federal is federal and you can't pick and choose??? The best you can do is argue that the federal "law" is unconstitutional.

Maybe he should spend more time getting 2A violators I'm his own state arrested and prosecuted. Like the DA in STL harassing people protecting themselves from BLM.

The courts just demonstrated they are about as loyal to the Constitution and People of the United States as the Congress is.
 
Are they doing this in order to force a lawsuit at some point? Don't States vs. Fed suits to directly to the Supreme Court?
Any challenges by private citizens wrt to a Biden ban would require a long expensive journey through the federal courts system, presumably though much more liberal and unsympathetic judges
 
They should arrest any federal agent stepping foot in the state and charge them with felony deprivation of civil rights. Then once in jail take 10 to 20 years to figure out how to handle the case. It's only fair because they would do the same thing.

You can't have it both ways. You can't say that states have Right X and then come back and argue that they don't have Right X. Either federal law is federal law (I think the case was some upper-midwest state and NFA stuff) or it isn't.

That tells us there's an agenda, and it's the holy grail for the Establishment: the complete elimination of those pesky peasants from power. Lest we forget, at bottom THAT is what The Great Reset is about: The Empire Strikes Back, the elimination of populism, and the concentration of power in the Priestly Class that is the politicians, bureaucrats, and Conhugeco execs.

Missouri county authorizes sheriff to arrest any federal agent enforcing policy that violates the 2nd Amendment​


The Newton County Commission in Missouri has passed an ordinance that criminalizes the enforcement of any federal law that infringes upon the 2nd Amendment right to keep and bear arms.

The "Second Amendment Preservation Act of Newton County Missouri" cites the state of Missouri's own constitution to further justify the legislation:

All federal acts, laws, orders, rules, and regulations passed by the federal government and specifically any Presidential Administration whether past, present, or future, which infringe on the people's right to keep and bear arms as guaranteed by the Second Amendment of the United States Constitution and Article I, Section 23 of the Missouri Constitution shall be invalid in the county," the act reads.

The new law is meant to counter all federal policy that would track or register firearms and ammunition. Democrats in Washington, D.C., have been discussing the possibility of such policy in recent weeks.

Although it is part of the larger Second Amendment Sanctuary movement that has been spreading around the country, the Newton County policy goes a step further. It not only shields individual rights, but it gives the county sheriff "full authority to make an arrest of any and all federal agents that violate state laws and enforce regulations."

Missouri County Ordinance: Sheriff Can Arrest Feds Who Enforce Gun Control​


An ordinance passed by Newton County, Missouri, not only nullifies new federal controls within the county but also makes clear the sheriff can arrest federal agents attempting to enforce those gun controls inside county lines.


The Daily Wire reported the ordinance on February 21, 2021. It was approved by Newton County Commissioners on February 3.
