I cant seem to find the section on mass wildlife website that sights the fines and or punishments for violation of Mass hunting regulations.

Seems my friends son was out with his BB gun and ran into some issues.

Thus far all I know he was charge or written up for

No license to hunt mass, Taking game out season or not allowed , Failure to wear orange ? this one has me stumped as I did not know you needed to wear orange all the time ? he rambled off a few other. More to do with shooting game out of season(Seems he was just shooting everything) He also was charged by police for trespassing and violation of some town law about discharging a pellet gun. Seems they have a small bylaw about any thing able to discharge a projectile by any means including air and springs.

He was giving very little information other than a date to appear in court for the trespassing and the local discharge ?

yeah, hes calling me back friday. More or less was just wondering what could happen. I may see him saturday and hes giving me alook see of the paper work. thanks for the MGL sections. this is what I was trying to find.

These are more common than one would imagine.

Either the cop is highly incompetent or he shot his trap off about shooting squirrels or some other such stupidity. I can't stress how important the 4th and 5th amendments are.

here is what happened. He was out in the only large stretch of woods shooting his BB gun(i dont know what he has) Apparently a game warrden aproached him and asked him about the pile of dead squirrels and birds. Asked him for a hunting license, which he doesnt have. He then have him a slip of paper listing all the non game or out of season animals he took out. 250.00 in fined ranged from 10.00 to 50.00 and was told he was lucky he did not take out any protected animals. Told him it was his lucky day(I am asumeing the paper he gave him is a warning of WHAT could have been, as I find it odd that he gave him no other info ie payment details ect ect) then told him to go get his license and then you can hunt LEGALLY for the game in season........Now the local PD shows up as he makes his way back to where He and the wildlife officer where parked. Local police arrest him for trespassing. Dan my friends son said the wildlife officer tried telling him that was not warrented and has already handle it. Anyhow hes off to court for trespassing charges next week...

The pile of dead birds explains the other hunting related warnings.
Off to court for the trespassing charge but none of the other charges? Or the discharge law too? How old is he?

You didn't say what town in MasSucKchusetts this was. "Usually" trespassing is a warning or a notice to appear will come later, arrest is not usually allowed unless it is tespass after notice.

Whatever town it was they are either complete and utter A-holes or this kid has a history with the local PD. And I don't see the latter as an excuse, merely an explanation.

PM me the town. I have a data base that lists every town's bylaws in relation to hunting and shooting. IF he was in a town that doesn't require permission to shoot on private property then I bet the trespassing charges won't hold.

spoke with him today,
at least the kid was smart enough to get the EPO name, a call to the local office and it was clear that he was given a warning theres nothing more to come of it.
As far as the trepassing: Im only going by what the Kid (19 years old) told his dad and then told me. He has a court date for the trespassing thats about all I know. My buddy said he went to PD today and they where professional but said at this point they cant do much. Just show up for the date in court.
I assume they will not persue it ? As far as the LEO in this area they can a PITA the last remaining patch off open land is mostly swamp. He parked in a bad space which is another piece of property. Parking there has been a ongoing issue even 25 years ago. Its not the easiest spot to get to either. This may have warrented the trespassing ???
Well its not like the kid didnt know. he was hunting ilegally or parked in a known hot spot.

court date is for trespassing only, he was parked on a piece of property which has been a on going issue there for ever, hunters, woods parties ect ect. He basically drove across a grassy cleared section and over the old rock wall to get where he parked. As every one does as it is hard to see your car once your in there. Any how in a nut shell for the most part it looks as if it will be a show up in court and DWF. The BB gun discharge thing was dropped as it appears it is only for discharging across a road way or from a motor vehicle which includes paint ball guns. Also includes any town property.

Thanks all,
