LEONARDTOWN, Md. (AP) — A Maryland State Police trooper responding to a pair of 911 calls shot and killed a teenager who was pointing what investigators determined was an airsoft gun at him, authorities said Tuesday.
The shooting occurred after state police received two 911 calls about someone acting suspicious, Superintendent Woodrow Jones II told a news conference. The first caller said he thought the person had a gun, left a telephone number but didn't give an address before hanging up, Jones said.
A second caller gave a street address for the suspicious person that was a short distance from the Leonardtown barracks, but the caller hung up before identifying themselves, Jones said.
Jones said the trooper, who responded alone, encountered Peyton Ham, 16, who he said had a gun and a knife. According to the superintendent, a witness said they saw Ham in the driveway of the home “in a shooting stance" and pointing a weapon at the trooper.
“The trooper fired at the male, wounding him,” Jones said. According to another witness, Ham then pulled out a knife and tried to get up.
“The trooper ordered him to drop the knife before he fired again,” Jones said, adding that the trooper reported the shooting and called for emergency personnel while other troopers gave first aid. Ham was taken to a nearby hospital, where he was pronounced dead, Jones said.
An investigation revealed that the weapon Ham wielded was an airsoft gun, which is commonly used to shoot BBs and which Jones called “a close representation of an actual handgun.”
The teenager was white, as is the trooper who shot him, according to Maryland State Police spokesman Greg Shipley.
The trooper, who has been with the state police for two years and seven months, has been placed on administrative leave pending the investigation, Jones said. The trooper was not hurt, he added.
Maryland State Police troopers don't wear body cameras, and Jones said investigators will look for video from the surrounding area. He said dashcam video didn't capture the incident.
Leonardtown is about 60 miles (95 kilometers) southeast of Washington, D.C.

 
Soon to be banned
It's actually surprising airsoft was never given a hard time considering the backdrop of the late 80's/early 90's issues with Entertech and Laramy squirt guns looking real enough to get kids shot. They were forced to start painting them crazy bright colors at one point because of this reason, so it's kind of a miracle that airsoft was never forced to do this. I also think that's why Nerf has always stayed away from making black guns--liability issues.

Probably because shooting someone pointing an air gun at you without proper ppe is justifiable. Even airsoft can destroy your eyes. Idk about you but going blind for life falls under threat of serious injury or death to me. Some pellet guns and bb guns now could probably ramp that up to potentially fatal injuries, some of them are pretty powerful. Squirt guns and nerf guns are different, they absolutely should be made to look specifically like toys as they can't really hurt anybody.
 
Assisted suicide.
The kid would be alive had he not first pointed a gun at a police officer, and then picking up his knife once the trooper responded as if the gun was real.
A lot of kids with bad intentions use these airsoft to make people think it is a real gun. Don't acted surprised when someone does respond as if it is real.
Can't issue ROE to police that they must wait until they are fired upon so they are sure it is a real gun. [Only soldiers in combat zones are required to do that. And they still get prosecuted for murder when they kill armed terrorists.]
