IIRC, it is a drug conviction and doesn't meet the Fed criteria for NICS to fail.

However that memo basically tells me that in spite of that, if they were ever to become aware of his MA status, they could prosecute as a PP. If he moves to another state it sounds like he would not be a PP.

Be careful with this. A friend of mine got his ltc-a no restrictions and purchased a gun through ffl without issue. Went and tried to purchase another gun and got delayed/denied. Appealed to the batf about denial and they stated he was a fed PP from a poss class d (mj) in 1981.
I told him to contact a lawyer but I don't know how it will go.
