A follow-up investigation resulted in the recovery of over one ounce of marijuana from inside the vehicle and on Anderson’s person. Police also recovered $350 in cash. Blondin and Hanafin located a loaded 9mm handgun in the center console of the vehicle. James acknowledged ownership of the firearm and does possess a valid license to carry (LTC) a firearm issued by the Yarmouth Police Department. He could not provide police with a reasonable explanation of why his vehicle contained both narcotics and a loaded handgun. Officers seized both the handgun and his LTC. James was placed under arrest and charged with failure to stop for a police officer, possession with intent to distribute marijuana, and conspiracy to violate the narcotics laws. Anderson was charged with possession with intent to distribute marijuana and conspiracy to violate the narcotics laws.

While I'm going to leave the drug charges and the drummed up charges alone, anybody should have the right to protect their life, just like the guy that was alleged to be selling medical marijuana awhile ago that was posted here. A clear difference between gang members with offensive weapons and someone carrying a defensive weapon.

Why is the fact he had an LTC relavent again??? and when did pot become a narcotic? and why is it a crime to have $350 cash? I cant wait to get out of this state........
 
I love how any 'narcotic' adds the intent to distribute charge... 1oz doesn't last that long, guess they want people to deal with criminals more frequently. if your distributing you have lbs or you aint making shit

Um.. well, the LOADED handgun (OMG, LOADED!?!) to protect himself, and the weed.. to smoke and relax so he can continue to live in this F'd up state. Sounds perfectly reasonable to me.

Oh and the $350? I didn't know that was a problem too.. didn't know cash was illegal now too?

Guy: So what you really mean is you're going to violate a bunch of civil rights, and throw a charge that is your word over mine regardless?
Law Enforcement Officer: Yep, exactly, that's usually what we do when encountered with such an opportunity.

I thought conspiracy required more than one person. Who is he conspiring with to smoke weed?

I guess when you have narcotics AND some pocket cash, I guess that makes you a dealer, huh? Not trying to say that the guy was not up to no good, but the fact that he had a legitimate LTC casts some doubt in my mind that he was a "dealer". More likely, it was for private consumption, or a party he was going to have.
 
The trouble started for him when the mall parking lot was under local and state pd surveillance and he was seen dealing. I believe that's where the conspiracy charge comes from.

You know your police departments are failing when they "utilize" hundreds of thousands of dollars of equipment to go after street level drug dealers lol in mall parking lots. Yeah, let's waste exuberant amounts of tax money so we can bust a kid for high school level drug distribution, let's do exactly that. Who are they hiring these days? Seriously, mall parking lots? They couldn't get a bit more creative....like... tail a suspected drug dealer to his higher level distributor? Trivial thought. Are these the same guys that shot the bengal tigers?
 
Sorry but what he did is illegal so his bad. If you don't like the laws then work to change them. Until then play with in the rules.

So you are for "gun control"? Please point out to me in the Constitution where it says who is and who is not permitted to defend themselves.

How is this guy having an LTC relevant to any part of this story?
