LTC-A unrestricted, denied when buying a gun...

I want to tell you guys about my depressing story that I'm going through. [sad2]

I recently received my unrestricted license, a couple days later, I went to the gun store in NH, bought a gun and got it transferred to MA, a couple days later I went to pick it up and my status came back - DELAYED!

Very frustrating, but I get a call today telling me my NICS came back DENIED!!! [frown][frown][frown][frown]

I appealed it through the NICS website and now I'm patiently waiting [sad2][sad2][sad2][sad2][sad2]


The reason for denial, is because my older brother used my name in an arrest a few years ago. Local PD background check seen this but dug into it a little bit and could clearly see it wasn't me. NICS just seen it, and boom... denied.
 
You're gonna need to a VAF UPIN, yesterday, because otherwise you'll get falsely denied each and every time.

You need to go find your older brother and kick him in the groin a few times.

Were you given an actual reason for the denial, and by whom? Jack.

I wasnt given an official reason for denial by nics, but the detective for my local PD said he can bet it was the reason I listed about my brother.

I already appealed this, but where do I apply for a UPIN?

**Nevermind, I read that I need to wait for the status of my appeal first.

They're not allowed to tell you exactly what the problem is.

Even the NIC's examiners that process the 4473 information don't know. All they see is 'proceed', 'deny' or 'delay' (or, so I was told).

Like you, the only way I found out was from a few sympathetic cops and probation officer that divulged the info and rap
sheet to me.

My brother has been in and out of jail his entire life, drugs corrupted his life, so it doesn't surprise me.

I just want the gun I already paid in full for and is waiting for me at the shop.
 
do an appeal and within a week they mail you the reason then they will send you a voucher to get it from the store. took my friend 2 months last year

If I recall, mistaken identity is one of the few (maybe only) reasons you can have your record expunged in Mass.
 
I've got a upin, STILL get delayed!!!!!![angry][banghead]

How long is the delay? Is it days at a time?

Makes me wonder if something like this is viable material for a federal lawsuit. A right delayed is a right denied, is it not? And someone with a VAF UPIN has clearly acted in good faith to prevent such delays.

I have a relative of about the same age, same name except for MI, and with a very lengthy criminal record. Among other things, as a kid he set his neighbor's house on fire, set his own house of fire and then set the police station on fire because he didn't like how they treated him. This before the age of 18. It goes downhill from there.

I keep wondering if/when this will bite me in the ass...

They called me, but after they had gone to the FFL where the denial occurred and he told them I wasn't the guy
when they showed him a pic of the person they had on file.

it depends, sometimes a day, sometimes 3. really pisses me off when I'm out near boston or something and stop at a shop to buy something and get delayed. end up having to do a 120+ round trip to go back for it a few days later is BS. most times now i don't even bother trying to buy something not close to home. the last thing i was delayed for was an ak receiver, just a receiver. isn't that just a 4473? but still even with upin it happens. complete bs. i stick to searching for things like ammo when not near home as they don't delay people for that, YET.

Just for clarification, do you mean the PIN given to you by the state/local PD, or a UPIN issued by the FBI?

Nobody has contacted me yet.... The place I purchased my weapon isn't near by either, so I wasted 2 hours just to get delayed and eventually denied.

There has to be a way to get this off my record completely! I really don't want to deal with this shit again.

If they're still working on VAF's from 10/14 per the post above, you might be able to save
yourself some time by submitting a letter of appeal first (not the same as a VAF)...

Be sure to included a set of fingerprints.

Mine took 6 weeks back in the day. How long it takes now?... I have no idea.

Once you receive it, take it back to the FFL where the denial occurred.
There will be a Check Sytem Transaction Number on it (NTN). They'll still have to contact NIC's again
(I don't recall if another 4473 has to be filled out). The FFL has to give them that number, and the approval
should go through.

The letter is only good for one time at that FFL, but you can purchase multiple firearms at the same time.

I know it's a major PITA, but you don't have any other options left.

One last thing, it's been at least 12 years since I dealt with this shit, so some of what I posted might have changed
since then, but from looking at the NIC's website, the basic procedure still looks the same.

The vaf upin. It was recommended to me to get one a few years back by Bryan from b&k in Natick when I got delayed in a purchase and had to drive back out from springfield when he got the proceed 2 days later...

The UPIN is for the 4473, a receiver in this state is just a 4473, but the UPIN is for that. You are getting delayed on the 4473, not anything MA is doing. MA has nothing to do with the UPIN from the FBI.
