Defense attorney Martin Kane explained that Vail and his father, Raymond Vail, and others were in the pub when Adam Faulkner and another man began to argue. Kane alleges that Adam Faulkner had been drinking most of the day.

Raymond Vail tried to intervene, but flipped over a table in frustration, Kane said. Callen Vail's only involvement was to remove his father from the bar, the attorney said.

"He walked away," Kane said of Vail. "My client was not the aggressor."

Vail and his group walked away from the pub, but the Faulkners and two other women followed and began arguing with Vail's father, Kane said. Adam Faulkner allegedly "tried to take a swing at Raymond Vail and my client stepped in," Kane said.

Vail knocked Adam Faulkner to the ground and the victim hit his head, according to Kane. Kane said another man kicked Adam Faulkner, not Callen Vail.
