LLC related NFA Questions

I checked the Q&A for the answers to these questions but I did not find them.


I am opening a LLC in Michigan (I own a house there and will be moving there in the next few years to start a FFL dealership). I am also getting a Federal Tax # for the LLC as well. I choose to use MI due to the startup fees being 1/10 (10%) of what is costs MA. Not to mention I want to avoid doing a LLC move when I make my move.


With that said, I do understand that I can purchase NFA item under this LLC. But I am unclear on the following:

1. Do I have to go through a MI FFL dealer since my LLC is in MI? Or can I still use a MA FFL dealer? I am not sure it really matters since the ATF is what eventually signs off on it. And since I do not need a CLEO signature, is there any reason a MA dealer would not complete the transfer with an approved stamp?


2. Can I legally possess aa SBR in MA under an LLC based in MI? I know the MA laws state that I do not need a special license for a SBR, so this would be different than a machine gun. But I am not sure if there is any special MA state registration for a SBR other than the ATF form #4.

Any info would be greatly appriciated.

Answers.
1. Is this really a question in your mind? "Not sure it matters???" That is exactly what matters...Your LLC is a MI entity if you want to buy NFA w/ it (until it is itself an FFL) you will need to buy them in MI... ATF wont approve it.

2. Once your MI LLC owns NFA, if it wants to bring thaat NFA into MA it will need to file an ATF 5320.20 (to transport NFA accross state lines). What ever you intend to bring into MA will need to comply with MA laws.

I am still trying to figure out what is controlled on the federal level and what is controlled on the state level. And I am sure some of my questions may seem silly to those who know, I need to ask so that my knowledge can grow.

Answers to part two.

1. Correct. but I'll get hung up on semantics for a momment, (even without an FFL) you can "purchase" (as in pay $$ for) in any state, but it has to transfer thru an FFL/SOT in your state.

2. Also correct. To take it out of state you need an atf form 5320.20 approved, (you can do them for a year if you frequently go to the same place out of state).

Mostly what securityboy said. Regarding the above, you do not need to have a FFL yourself to purchase NFA Items. Having one will make it easier but you will need a SOT to go with the 01 or 07 FFL in order to have the NFA Items transfered to your own FFL/SOT. Having a FFL&SOT will make it easier to travel with them as you won't need to file the 5320.20 for each state you intend to travel to.

The SOT (Special Occupational Taxpayer) will cost you $500 each year.
