Littleton Residents - We need your help!!! - FFL Attack underway

Need to get the NSSF involved. If this stands, allowing a town to enact their own regulations beyond both the state and fed, is going to have far reaching implications.
 
We already have that now with each local Police Department deciding if you can carry.

NSSF is more for the trade businesses than for individuals. They may be more geared toward this.

Our Mission
To promote, protect and preserve hunting and the shooting sports. Formed in 1961, NSSF has a membership of thousands of manufacturers, distributors, firearms retailers, shooting ranges, sportsmen’s organizations and publishers nationwide.

 
They tried to dismiss the meeting for passing the alotted time. We shot that down. We are getting to article 16 tonight

I'm hung up on the "required inspections".

There ARE no required town level inspections. Inspections are on a federal level (ATF). The town is involved only so far as issuing a small business license and the PD handles the dealer licences. Both of which they're already paid for.

One person asked for clarification on the number of dealers. The answer was either 48 or 49 (chief said both numbers at different times)
One speaker asked questions about number of inspections per year, how much would be charged, etc. Clarity on fine but not inspection fee. Chief said 50-200 still working it out. once per year. Thank you to this speaker.

That was it. it then got voted on and passed

At that point in the night it was going to pass. The place was still relatively full and people wanted to kill the MJ dealers. It would have taken a long line of persuasive speakers to have any chance.

We now move the fight to the next stage.


As Jim (@EddieCoyle) mentioned, the Chief is a reasonable person within bounds. He stated publicly that he does not want to do the inspections but that state law says "shall inspect once per calendar year" and he needs money to offset the administrative cost of this burden. We understand his perspective. The bylaw is a steaming pile. No matter how reasonable the Chief and Board of Selectmen are, it is a sword held over the head of the dealers. A anti can easily enact oppressive safety regulations and then fine us $300/day for violations until we go out of business. Similarly the $50 to $200 /yr inspection fee can turn into $1000 or whatever. The bylaw does not stop them from doing whatever they want.

The licensing authority shall enter, one time per calendar year, during regular business hours, the commercial premises owned or leased by any licensee, wherein such records required to be maintained under this section are stored or maintained, and inspect, in a reasonable manner, such records and inventory for the purpose of enforcing the provisions of this section. If such records and inventory contain evidence of violations of this section, the inspecting officer shall produce and take possession of copies of such records and, in the event that the licensee subject to inspection does not possess copying equipment, the inspecting officer shall arrange to have copied, in a reasonable time and manner, such records that contain evidence of such violations and the costs for such copying shall be assessed against the owner of such records. Licensees found to be in violation of this section shall be subject to the suspension or permanent revocation of such license issued under section 122 and to the provisions of section 128. Nothing herein shall prohibit the licensing authority or the department of state police from conducting such inspections pursuant to a valid search warrant issued by a court of competent jurisdiction.

As I just posted, MGL 140 123 says that the licensing authority (local PD) "shall" inspect the dealer annually.

How would you like it. You run a Vegan, GMO-free, LBGQTAXW Yoga studio. You have been running it for years and essentially break even. You are doing it for enjoyment and because you are fine upstanding LBGQTAXW supporter. The town decides that they need to put in place safety regulations to protect the public safety and will fine you $300/day. They then want to inspect you and will charge you whatever they decide for that inspection. Oh, and you need to keep on file all your licenses with the town clerk.

Now you are going to lose money on the inspection fees alone and have no idea what the safety regulations and fines might do. Sounds reasonable? This would never happen to a LBGQTAXW establishment, but because this is about 50 GUN dealers, this type of arbitrary burden by the town is "reasonable".

It's Ma. and this is how liberals operate. They use the govt. for their causes and ignore laws they don't like ir agree with. This is what you get in a corrupt one party State which is a liberals dream. Let us know when the inspections start and the cost, I would gladly contribute to a fund to pay the fees just to piss off the Littleton Libtards.

Ok. Fair enough, I guess. Still, that inspection could be could be done in one day by instructing all the dealers (many/most?) of which have hours by appt anyway, to be present. Walk through, spot check whatever and be on their way. As everyone has already pointed out, this is just a way of edging out legitimate businesses.

Not "legitimate businesses", firearms dealers. This is pure harassment and prejudice.
