Mother finds guns in closet

Leominster teen pleads not guilty to weapons charges

LEOMINSTER— A Salisbury Street teenager pleaded not guilty to weapons charges yesterday that were brought after his mother allegedly found sawed-off shotguns and other firearms in his closet.

Nicholas Pedreira, who turns 19 today, of 20 Salisbury St., was charged with three counts of improper storage of a firearm and two counts of carrying a firearm without a license.

Police were summoned to the Salisbury Street home by Nelly A. Connelly, identified in court papers as Mr. Pedreira’s mother. She told police she had been cleaning her son’s room and found three weapons and ammunition wrapped in a blanket on his closet floor.


She said she asked her son about the weapons and “he became angry and scared, acting like he was in some type of trouble,” according to court records.

She said she told him to call police to get out of this trouble, but he left the house without doing so, according to police reports.

Officer Emmanuel J. Tocci arrived at the home and found Mr. Pedreira in the driveway with his mother, father, stepmother and stepfather. The officer asked if he knew why he had been summoned.

“He responded, ‘The guns in my closet,’ ” Officer Tocci wrote.

Police recovered a .410-caliber sawed-off shotgun, a .22-caliber long rifle with a sawed stock, a 12-gauge sawed-off shotgun and .410-caliber shotgun ammunition.

Judge Edward J. Reynolds allowed Mr. Pedreira released on his personal recognizance.

So what was he carrying?
 
There goes any chance of him ever "legally" owning a gun. It must really suck growing up in an antigun household. All I had to do was ask and my father drove me over to the local gunshop and we bought a gun together....I was twelve.

Wonder how short the guns were cut? I also wonder if the kid realizes that MA has a life imprisonment potential for use of a sawed off in a crime?

The firearms didn't walk into his bedroom closet all by themselves did they?

I don't think that the act of "carrying a weapon" as defined in MGLs includes someone (could have been a licensed friend for all we know, even though unlikely) transporting them to his house.

Also weird is 3 guns = 2 charges of "carrying"? If your theory is correct, why not 3 charges of "carrying"?

I could see charging him with illegal possession, but not "carrying" if they were in a closet and nobody saw how they got there.

If he spilled his guts to the officer about carrying the guns, etc. then all bets are off and he "earned" the charges by being stupid and not knowing when to keep his mouth shut (lawyer up).
 
I have a feeling that this kid is a "loser", up to no good.

Have no fear, he'll have plenty of guns over his lifetime . . . in between prison sentences for things liked armed robbery, etc.

Doesn't sound like he was just a kid that wanted a gun, more like a criminal with his stash to go get more guns, money, drugs, stuff to fence, etc.

I have to say that the police report would be a bit more detailed than a news blurb.
I think in this case you'll find that they would use either "carry" or "possesses" under 269s10. The end result will be the same.
If my kid had a couple of sawed offs the police would get him after I had it with him.

Frankly my gut reaction is I'm proud of the Mom for blowing the whistle. Most times when somebody gets pulled in for illigal posession of a firearm, usally thier Mom is outside the courthouse crying about what a good boy they are. [rolleyes]

Well no worries for him, he'll be out in a few days, and while never being able to legally own a gun, if he doesn't change his tune, I doubt he'll care.

The feds weren't interested because he's not an otherwise law abiding
citizen, so the shock value of smashing his door down and taking him and his
guns would have very little real effect on other lawful gun
owners. (tic). They also were relieved the pleasure of entrapping him
with an undercover agent, as he had committed the crimes himself or
whoever he bought the guns from did already.... so they missed out
on that, too.
