Going to the range after work in MA, what to do with pistol?

Let's say I want to go shooting with a buddy after work. I live outside of boston but work inside. We'll be meeting in Boston after work and driving to the range. I have a Class-A LTC restricted. (BTW, gun is not hi-cap)

What can/should I do with my piece? I'm only bringing my handgun. Is it lawful for me to carry it in a locked container in a backpack? No ammo would be with me. Is this lawful? I would like to be able to ccw for the day because I'm on my way to the range, but I know better than that!!

I appreciate any/all suggestions or conversation about this topic. Thanks.

IIRC, with a restricted license, you have to go from A to B with no stops in the middle. So I don't think it would be legal for you to take the gun with you from home, to work, then to the range.

I'm sure Len can straighten us both out here! :D

But being a restricted LTC like AdamMA said you have to go straight from point 'A' to the range and back to point 'A', with no stops along the way not even to use the restroom.

What is this "direct route" issue? Sounds as if some are confusing the INTERSTATE transportation of arms under the FOPA with Mass. law controlling vehicle transportation.

For an LTC holder, here is the controlling law:

(a) No person carrying a loaded firearm under a Class A license issued under section 131 or 131F shall carry the same in a vehicle unless such firearm while carried therein is under the direct control of such person. Whoever violates the provisions of this subsection shall be punished by a fine of $500.

(b) No person carrying a firearm under a Class B license issued under section 131 or 131F shall possess the same in a vehicle unless such weapon is unloaded and contained within the locked trunk of such vehicle or in a locked case or other secure container. Whoever violates the provisions of this subsection shall be punished by a fine of $500.

(c) No person possessing a large capacity rifle or shotgun under a Class A or Class B license issued under section 131 or 131F shall possess the same in a vehicle unless such weapon is unloaded and contained within the locked trunk of such vehicle or in a locked case or other secure container. Whoever violates the provisions of this subsection shall be punished by a fine of not less than $500 nor more than $5,000.

Please show me ANY reference to stops, detours or anything else remotely related to destinations or routes....... [roll]

Adam, I'm with Scrivener here!

You can carry a gun in a locked case (transport) all day long, every day, even with a LTC-B that is restricted to T&H!

You can legally leave it locked up in the trunk of your car, or lock it up in your desk at work (legally, company rules are a "personal issue").

You can have ammo with you, you can have hi-cap mags (assuming ANY LTC-A), etc. Just not loaded or "carried" on your person (locked in backpack unloaded is NOT "carried").

It does NOT matter if you are in Boston or Norwood MA . . . the above applies anywhere/everywhere in MA.

You can stop for coffee, lunch, dinner, dancing, etc. in this mode. You are absolutely legal!

Must ammo also be locked? Such as, if I put my locked case in my pack and throw two boxes of WWB in the pack next to the locked box, am I still cool?

I stand corrected... Thanks guys.
See, that's why I LOVE this place so much. Just ask, and you will get honest and concise answers.

I'll chalk this up with all the other misleading rumors that are around, like not carrying a firearm into any place that serves alcohol.

Thanks again guys
Adam

From the GOAL Foundation Basic Pistol class:

Transporting Guns in a Vehicle

Handguns with a License to Carry Class A:
If loaded, then they must be under your direct control.

Handguns with a License to Carry Class B:
They must be unloaded and contained within a locked trunk, or in a locked case or other secure container.

For large capacity rifle & shotguns:
They must be unloaded and contained within a locked trunk, or in a locked case or other secure container.

For non-large capacity rifle & shotguns:
Not cited in the law other than must be unloaded while in or on a vehicle.

Because the law is unclear, it is not recommended that ammunition and firearms be transported in the same locked container.

ETA:

For storage:

“It shall be unlawful to store or keep any firearm, rifle or shotgun including, but not limited to, large capacity weapons, or machine gun in any place unless such weapon is secured in a locked container or equipped with a tamper-resistant mechanical lock or other safety device, properly engaged so as to render such weapon inoperable by any person other than the owner or other lawfully authorized user. For purposes of this section such weapon shall not be deemed stored or kept if carried by or under the control of the owner or other lawfully authorized user.”

This begs the question as to whether you would be "leaving" or "storing" the firearm in the vehicle. GOAL recommends extreme caution in regards to leaving a firearm or long gun for extended periods of time. There (to my knowledge) have not been any court cases to determine at what point you are transporting and when you are storing.

Myself I would say to keep the range bag locked and with you.

You DO realize we have a Gun Laws section, don't you?

AND Packing.Org... ( www.packing.org )

AND GOAL... ( www.goal.org. )

Packing.org, while a great site, can't always be trusted to the letter. They have 50 states to stay updated on and keep track of. From time to time I've noticed something that wasn't correct and emailed them. As an fyi... :D

You're welcome.

Our job is to moderate this forum (Derek included because he owns it) and to help those who ask questions, as well as being silly, because GOD knows this state is enough to depress anyone who lives here and wants to own guns. Now, if there is a question that the 'Lay" folks don't know or can't answer, then we do have a couple lawyers who are willing to chip in and answer the question, OR folks go to GOAL, the MGL's or Packing.org.

One would suggest that if you find the question irritating, you ignore it and go on to the next topic. We do our best to keep this a friendly place, and if people can't answer in a civil "tone", that's when we (the Mods) begin to frown and we have to become the heavy's.

Now - all that being said - everyone PLAY NICE!
