GA - State Superior Court Judge Shoots, Kills Intruder

A Superior Court judge shot and killed a masked burglar inside his Augusta home early Friday after being awakened by the sound of someone smashing through a door.

Judge J. Carlisle Overstreet, 65, was awakened at about 4 a.m. Friday when burglars used a large rock to break glass panes in a French door at the judge's home, the sheriff said.

He said the judge grabbed his gun after hearing voices and left his bedroom to investigate.

Police found no weapon on the slain suspect. Still, the sheriff said Overstreet was justified in shooting him.

"You're protecting yourself," Strength said. "You don't have time to say, 'Sir, are you here just to steal something or are you here to shoot me?'"

The young burglar shot dead by a Superior Court Judge Carlisle Overstreet had quite a criminal record. 20-year-old John Howard Junior has served time for shoplifting, burglary and theft.

Court documents show when he was behind bars last year, Howard wrote several hand written letters to a friend blaming a 2008 crime spree on drugs. It was the start of a rap sheet that ended Thursday morning.....
