I really really doubt it.

It seems that a black rifle with a beta mag (I think) now constitutes an automatic rifle.

The first 3 rounds sure do sound like automatic fire. They report that the suspect changed gun at that point, due to a mag failure, so I'm thinking a poorly done home brew modification.
