Fixed Mag AR Assault Weapon Charge

I am posting this as the manufacturer of these firearms, we can finally put this topic to rest....

Today we claimed victory in Dedham District Court.

Not too long ago, an individual was charged with an Assault Weapons Ban violation for possessing a JC Arms pistol. How could this be? JC Arms makes fixed magazine receivers...well, this particular police department did not care and charged this person anyway.

What happened next? The owner of JC Arms immediately hired the 2A Attorney to defend the erroneous assault weapons charge. AttorneyAndrew Couture filed a motion to dismiss, and JC Arms owner, Joseph Carl provided sworn testimony as a subject matter expert, refuting the charge. The charge was dismissed for lack of probable cause this morning.

We tell you this for a number of reasons:

*The 2A Attorney is your go to guy for gun law.

* JC Arms stands by their product, they paid the legal bill for the defendant. What other firearms manufacturer would do that?!?!

It is also important to note that this case centered around “originally manufactured” receivers. JC Arms Receivers are now, without a doubt, compliant with the laws of Massachusetts...we already knew that, but now there is legal precedence.

Dismissal of a charge for lack of evidence does not establish a binding judicial precedent, though defense counsel is free to ask the court to take note of such dismissal.

Establishing that the firearm doesnt even meet the criteria for an AWB charge at the DC level is huge...you have to start somewhere. No PC ever existed for the charge, it should have been "NO PC'd" at the initial arraignment.
 
Props to Joe who gave me lots of help for my pistol build and for his customer support such as this case!
 
Anyone with firsthand experience with a fixed mag receiver and loading issues? Easy, pain in the ass? Looking st building a pistol from one

Just as MuzzleDiscipline stated it is very easy. Even faster than a standard mag reload if practiced. Build that pistol!
 
Was the issue at hand the fact that it was an AR in violation of Maura’s edict or a pistol over 50oz, or something else I’m not thinking of?
