It was the most violent attack on the Capitol since the War of 1812, forcing lawmakers and Trump's own vice president, Mike Pence, to scramble for safety.

If you ignore the time a person of a certain background crashed into the gate, killing a Capitol police officer. Technically I guess this was a couple months later.

It may be difficult for the prosecution to prove that what the OKs say was their intent was just a clever legal manuver. Especially since those “gear and weapons” were not employed. My gear and weapons are stashed outside DC too - just a longer ways off 😉

That the OKs were not “American troops” seems confounding To the Insurrection Act defense. I can’t say I know who can “call up” the citizenry militia, in theory or practice.

The defendants have said in court filings that they used bombastic language but didn’t have a real plan for any violence. They assert that they went to Washington to help with security and logistics for a Trump rally that took place before the rioting… The defense also hinges on the Insurrection Act, an 1807 law that allows a president to deploy American troops inside the country. In the days before the Jan. 6 attack on the Capitol, some of Mr. Trump’s allies urged him to invoke that law and unleash the military to help keep him in office.

The defendants have said that they brought gear and weapons because they sincerely believed Mr. Trump would invoke the Insurrection Act. For that reason, they have said, they lacked the required criminal intent for seditious conspiracy. “What the Government contends was a conspiracy to oppose United States laws was actually lobbying and preparation for the President to utilize a United States law to take lawful action,” Mr. Rhodes’s lawyers Phillip Linder and James Bright argued in a recent court filing.

Prosecutors have said that the defendants are seeking to use the Insurrection Act as legal cover and were plotting violence regardless of what Mr. Trump did.

Oath Keepers founder Stewart Rhodes was convicted Tuesday of seditious conspiracy for a violent plot to overturn Democrat Joe Biden's presidential win, handing the Justice Department a major victory in its massive prosecution of the Jan. 6, 2021, insurrection.

A Washington, D.C., jury found Rhodes guilty of sedition after three days of deliberations in the nearly two-month-long trial that showcased the far-right extremist group's efforts to keep Republican Donald Trump in the White House at all costs. Rhodes was acquitted of two other conspiracy charges.

Using dozens of encrypted messages, recordings, and surveillance video, prosecutors made the case that Rhodes began shortly after the 2020 election to prepare an armed rebellion to stop the transfer of presidential power.

Over seven weeks of testimony, jurors heard how Rhodes rallied his followers to fight to defend Trump, discussed the prospect of a "bloody" civil war, and warned the Oath Keepers may have to "rise up in insurrection" to defeat Biden if Trump didn't act.

One of Rhodes' co-defendants – Kelly Meggs, the leader of the Florida chapter of the Oath Keepers – was also convicted of the sedition charge, while three other co-defendants were cleared of the charge. Jurors found all five defendants guilty of obstruction of an official proceeding: Congress' certification of Biden's electoral victory.
