They had a warrant, I'm assuming for the premises but what happens in the case of a locked safe that he refuses to give the combo for?

During the subsequent search, detectives found two safes, one a floor model and the other a wall model. Also found was a single .223 caliber round and an empty box of 9 mm ammunition. Joshua Mendonca, 26, of 255 Mott Street was contacted by phone and stated he was on his way home, but would not surrender the combinations to the safes.

Detectives were able to gain access to the large wall safe prior to Mendonca arriving. They found a shot gun, shot gun shells, 9mm cartridges, empty ammunition boxes, a large sum of cash, and over seven pounds of marijuana.

Its all about confiscation of cash & assets. IMO/ Weed sales that are not getting taxed and the funds seized get redirected back to the FallRiver PDs budget sooner or later these days. JMO from a lot of reading, a real lot of reading up on this crap.
Delahunt was one of the first participants in its vote in's legalization & repurposing, how many prior weed dealers did he prosecute? Then he found the red tape involved in its sale/distribution was unreal even for him! Weed's now become as good as legal! By the time it gets to court the weed will be legal, its illegal distribution is BECAUSE of its missing tax revenue for the state. They hope its the next "lotto" that used to be illegal too eeh? Unreal.

I too don't understand the mention of empty ammunition boxes, that's no different than saying he had empty milk cartons. At that point, they are just boxes.

7 lbs of Mary Jane... That's waaay over the legal limit. You can argue if that should be legal or not - but right now - it's not. Mix guns in with possession of a controlled substance with intent to distribute and you're in a bad spot...

IDK what the case law is on the safes. Not sure a warrant for the premises includes inside the safes or if a second warrant would be required. Either way he's out his property. Now the point of the matter just determines if the contents are admissible.

He'll plea down and sing a song on his associates to keep his butt out of the clink.
