Driver Charged With Killing Alleged Robber

PHILADELPHIA -- An alleged teenage robber is dead after being shot and killed on a downtown Philadelphia street.

A 70-year-old man, victim of a chain-snatching, is being charged with the teen's murder.

Homicide detectives say 19-year-old Jamil Burton was killed after being shot multiple times in the torso and the head shortly before 2:30 a.m. Friday.

Fred Walz says he was sitting on his steps when he saw the teen -- first on a bicycle, then on foot -- and a man in a car chasing him the wrong way down 11th Street near Pine.

He says the driver went up on the sidewalk and hit the fleeing man, got out of the car and shot the teen.

Walsh says the driver, 70-year-old Barry Mason, was shouting that the teen stole a necklace from him.

Mason apparently had a permit
 
I hate to see anyone die. But if more 70 year old men acted like this guy there would be less 19 year olds thinking they can rip the elderly off.
 
Unfortunately, the law says pursuit is police business only.

Unless the old man gets jury nullification (and he certainly deserves it), he's going down.
 
Oh, I understand. You can't have people running through the streets shooting everyone either. He definately should have called the police...no doubt. I think he's going away too....

The problem isn't just that "pursuit is only for the police" (which isn't exactly the law), but that once the old dude caught the young one, he appears to have administered summary punishment. That's a no-no for everyone, sworn or not.
 
Even if this guy was in the right legally, he would still get bent over the
guardrail in Philadelphia.

A note to any who may have a PA nonresident CCW.... the "rules" change
in philadelphia..... Mayor Street and his police department are stridently
anti gun, so expect to get treated like you would in MA, probably
worse. Better yet, stay the hell out of Philly.
