Detained for trying to bring a gun to the Empire State Building

"....the right of the people to keep and bear arms shall not be infringed". Sir, you're under arrest for criminal possession of a firearm.

I must be missing something, like the part of the Constitution that says rights are only rights when granted or something like that.
 
I think he should have known better than to carry in NYC with no NY license....

But people have to know that going to New York is like going to a foreign country or planet. People have to look up gun laws before bringing one there. This one is all on that guy.
 
Those are different stories strangely enough. One guy was 79 the other 39. Guess lots of people go the Empire State Building strapped.

He is 79. Likely senile, and blissfully unaware that America has been falling apart around him. He probably thought the constitution was still valid.
 
Why doesn't the security desk simply hold onto the gun and return it as he leaves? Some places actually do that, and often without freaking out.

he probably carried a Garand for his country, so now for an oversight on his part they put him in cuffs.

Because in NY State, you need a permit to even own a pistol. NYC is even worse!

This is simply like getting arrested for being Christian, or Muslim, or writing a critical op ed piece, or having soliders quartered in your home in a time of peace... I'd honestly like to arrest liberals for speaking freely and see how that goes over...

Having him arrested is ridiculous, though.

I hate New York with the burning passion of a thousand suns. I avoid it like the plague, and try not to even stop anywhere in the state on my way to/from Pennsylvania when I go to visit family there.

I'm sure security is told to call the police for anything that happens. Not a lot of common sense in that city.
 
Security made me put my carry back in my car when I got frisked at the Hampton Beach Casino. True story.
 
I've carried under LEOSA in NYC a few times. The Empire State Building only allows NYPD, NY State Police, and .gov to carry inside. The Statue of Liberty, however, looked at my credentials, slapped a bright colored wrist band on me and told me to enjoy the rest of my trip..... So yeah, it may be because the ESB is privately owned.

You have LEOSA behind you. The vast majority of us firearm owners do not. You are definitely in the minority, by far, being able to enjoy a privilege that the rest of us peasants are not entitled to.

True, but I don't see how it is the job of a lowly security guard to enforce law and determine if someone had the proper papers to carry a gun. If a gun is not allowed in the tower, it isn't allowed, regardless of pistol permit. They either need to send him on his way, or lock the pistol in a bin for him until he exits.

That wasn't my point. I understand that I have a "privilege" not afforded to most people, but I believe everyone should have that right. I'm not bragging or saying I don't understand the issue. I was just sharing my experience in regards to the OP. I will admit that I may have assumed the OP was under LEOSA as well because if you get caught carrying in NYC without it you may have a very bad day...

There were some articles referencing that rapists/molesters would get less time than someone breaking the new gun laws. I was trying to find one, and I found this...which interestingly enough links to the board lol

that's because pedophiles like children while gun owners kill them.
 
IF you're going to NYC, you might as well assume that you're going to experience some type of security at any large attraction like the Statue of Liberty or ESB. The security people are even taking pocket knives away from tourists. I know this because my son-in-law lost a very nice Damascus Kershaw (only a 2-3/4" blade, too) to a guard who told him it was illegal length (!) and if he didn't surrender it right there he would had him until the cops came. That was at the Liberty statue, too. Go figure. I'm one of the "if it's concealed, it's concealed" gang but I wouldn't take a chance in NYC and therefore will never, ever go there again unless it's absolutely necessary. My wife shops there two-three times a year and I'd love to eat there more often but each time I got there I feel absolutely naked and vulnerable to the animals there carrying razor knives in their pockets.

This guy wasn't too bright. He should have just left the line.

He lives in a free state and didn't even think about it until he saw the sign at the ESB. At the minimum, we should have reciprocity between all states so this crap doesn't happen to lawful citizens.

A license is a license. We shouldn't need one, but if we have one all states should recognize it and leave us alone.
