Too many kids & idiots taking off the orange tips. Without the orange tip, these air soft guns, or bb guns, pellet guns, and the like, are often mistaken as real guns with real ammo. Yes they shoot a projectile, but nothing that would kill a person, & no apparent serious injury other than eyes & ears, but I've seen stories on the news & the papers where kids brandish these "toys" & end up getting killed by the police or another person as a result.

Too bad. You brandish something that looks like a weapon at a cop, you're going to get what you deserve. Stupidity is a capital crime, and the universe tends to punish it accordingly.

I think that the law instead should read something like "A person who kills someone brandishing a replica firearm cannot be charged for shooting an unarmed person, being that they had no way of knowing that what was being brandished was not a weapon".
 
That's already the case in a lot of places. Use of a replica firearm in the commission of a crime is treated as if the firearm was real.

Understandable & this is what the orange tip is supposed to be for, so it can be made known that it is not a "real" gun, but idiots take the orange tips off. I never was sympathetic to the morons for getting killed because of their stupidity. An officer has to protect himself, & I know whatever action they take is justified, just pointing out that the law makes sense, solely because of things like this. Maybe if these kids start getting arrested for taking off the orange tip, then the sensible ones will just not alter it.. Some kids are just being kids & not realizing the consequences of what they're doing, then there's the hoodlum idiots who think it's cool because of glorified crime & violence in rap videos, so they take off the orange tip because they think it's "dope Yo", [laugh] [laugh] [laugh] . Personally, they whip one out in front of police, they deserve whatever they get.

yep.. read about one of those in western Mass somewhere.. somebody robbed a bank with a toy gun & was still charged with armed robbery.

They should be charged as if it were real anyway, solely because of the pretense that they want or hope the victim believes it is real.

They wanted the victim to think it was real, & usually the victim does, therefore the law should treat it as if it were real, because the intent was there for it to be real.

Well... that's kind'a "damned if you do, damned if you don't" situation.

Last year, a bill was filed in the very same legislature that would have made it illegal to "possess, offer or expose for sale or give away any handgun that is coated with a color other than chrome, military camel, black, gray or nickel"

My guess is that somewhere, sometime, some how... some gang-banging genius came up with the idea of spray painting his "Glock Four-Tee" in Day-Glo orange so the Po-Po (or the "Oh my God... he has a gun" sheeple), would think that the turd is role-playing "Grand Theft Auto" instead of carrying the "real thing".

I believe NYC had/has proposed banning DIY firearms coating kits along the same lines as the CT legislation (no shocking pink or mossy-bling Lorcins/Ravens/Brycos).

Armed robbery is classified as a crime against the person (versus a crime against property), and the essence is putting the victim in fear. As a result, a claim to be armed, if credible, is sufficient to sustain a conviction. This includes a pointing finger inside a pocket.

Dumb idea. The more laws that exist, the more people can get charges
trumped up against them for doing something seemingly innocuous. Any
nanny laws like that give way to breeding MORE nanny laws.

Further, many/most BB guns don't have an orange tip. The idea is that
the manufacturer WANTS you to treat them as a real weapon of some
sort. I don't necessarily disagree with that standpoint.

IMO if you point anything that LOOKS like a gun at a cop, wether it has
an orange tip on it or not, you -DESERVE- to get shot/tased/arrested.

Further, I would not blame a LEO (or citizen) if he shot some teenager with
a pistol that had an orange tip. What if the gangbangers start painting
orange tips on their REAL pistols so that someone won't shoot them?

I'd rather see a law like what Ross is talking about- that for the purposes
of brandishing, anything that looks like a real firearm is considered a deadly
weapon. Not pointing a realistic looking gun at a police officer (or anyone
else for that matter) should be a matter of common sense.
