The ‘offending’ ad in question. So, under the CT Supreme Court’s majority ruling, Nancy Lanza was looking to get her man card because she was the purchaser. Makes total sense. Her son stole the weapon from her. He was never a/the buyer. He never attempted a purchase. This decision becomes more and more illogical and ideologically ‘guns bad’ than when it was announced.

I'm having some trouble following the logic thread as there seem to be some knots in it. The advertisement referenced here likely played no role in Nancy Lanza's decision to purchase the item being promoted. She purchased the item and lawfully held it in her possession. Then a third party, with no commercial relationship to the company producing and advertising the product, or any part of its distribution and sales channel, is allegedly motivated by the advertisement to commit multiple crimes in seizing possession of the item from the lawful possessor. The third party then intentionally misuses said item in the commission of yet another crime.

It makes perfect sense that Bushmaster should be held liable in this case.

Makes no sense and should not to people with half a brain. That this is somehow responsible for what a criminal did. Not disagreeing with you.

Newtown: The tragedy that keeps on giving.........

Doesn't this feel like the monster trying to breach the perimeter; hitting the walls regularly to see where the weak spots are until, maybe, it succeeds? That's how it feels to me. An incremental by consistant attack at the ramparts, looking for the weak spots in the interpretation of the Constitution or a place where a multitude of democrats will help that monster over the wall eventually......kinda like that movie "Z"?? Once a foothold is created then the infection can begin and the SCOTUS and the Constitution be damned.

Just for anyone who doesn't know, Connecticut is the crucible for the "deep blue virus" that is far worse than anything from the West Coast. This state will infect the others as there are zero checks on its growth and power. The liberal left have super majorities everywhere and we continue to have a leftist Governor. There is no stopping them including the use of the courts who always sides with them sometimes making up the law out of whole cloth. I've lived here all my life and can tell you that is most certainly true.

Our country is predicated on our Constitution which requires just one thing from all of us: an allegiance to and by its citizens. All it will take for this country to crumble is for enough "citizens" to refuse allegiance and who wish to ignore it's precepts. Does it begin with pro football players kneeling down in a sign of solidarity against it? Is that ground zero? The dozens of Democratic presidential candidates and a handful of infected congressmen have already made it clear that our current form of government is not for them or their constituents and socialism is the true way forward. You youngsters surely have a fight on your hands!

Yeah. While I am sure they would love a big win, they probably don't believe they will get one here. what they want is access to all the companies internal memos and discussions so they can show how mean and callous the manufacturers are and hopefully get some details they can use to help them frame future cases to be more successful.

I've been saying this since the lawsuit was filed.

Even the Connecticut Supreme Court acknowledged the way CUTPA's written doesn't favor the plaintiffs at all. Either way, win or lose, AR-15's will still be on the shelves.
 
It doesn’t really matter to the antis that they might lose, what this does is open up an avenue for lawsuits. Part of the game plan is to use the courts to bleed gun manufacturers dry. It’s what the law in question was designed to try and prevent.
 
How was the 'marketing' relevant in any way? Lanza didn't buy the Remington gun, having decided it was the most killy rifle he could find, based on a what, magazine advertisement(?).

It was the ONLY ONE in his mother's gun safe, so he stole it. Wouldn't have mattered what brand it was, that was the only one available TO steal.

So the 'marketing' nonsense is just that -- nonsense. There's no evidence he ever saw a Remington advertisement ever in his life, anyway.

If anything, they'd have a better shot suing the video game companies for warping his fragile mind.

Put me among those who say these Newtown families should have to reimburse Remington for all costs related to this frivolous suit. Something's got to end this nonsense, and triple court costs would go a long way.

There is so much that has been purposefully hidden from the public about this case by those in charge. It's because the facts don't support the narrative. There have been plenty of attempts to have the entire report released but those demands are ignored. I personally know one of the first responders and what he told me makes my head spin. Rest assured that the Liberals in our State had that anti-AR-15 bill written, waiting to be foisted upon us the minute there was another shooting incident. They wasted no time in presenting it and getting it passed denying us our constitutional rights. The "facts" that were used to condemn the AR were concocted and not relevant in a number of ways which I will not get into here. Rest assured, however, that they are bent on full confiscation and all that's happening now is incremental path to that ultimate goal. Until Connecticut residents wake up and learn to spread the governing authority between two parties instead of just one, it is a lost state for decades to come.

The anti-gun laws passed after Sandy Hook in Connecticut were done under the guise of "Emergency", and bypassed some of the normal protocols. Months after the fact, when no emergency existed. Adam Lanza started off by killing his mother, then taking her legally owned firearms and slaughtering children and teachers.

So, a fcked up teenager who BEGINS by killing his own mother is reason for the state to decide that AR's are evil, "high-capacity" magazines are evil, and my rights need to be infringed. And they just keep coming up with laws, and pushing for more laws.

There's an agenda, and it's to remove firearms from the citizenry.
Unfortunately it doesn't seem to take into account that only the law-abiding obey the laws.
I'm not going to disarm myself so that I can be a victim.
I'm NOT a predator, but I'm not going to be helpless prey.

Connecticut is a physically beautiful state, and even 10 years ago it was a lovely place to live.
Not any more.
It's a nice place to visit, it's a nice place to have a summer home, (or in my case - a camper).

But I gave up on Connecticut after living there for forty years; Georgia's my home now.

Now, families of the victims from the massacre at Sandy Hook Elementary School hope to replicate the tactic: using litigation as a means to pry open the gun industry, employing the discovery process to unearth internal communications and examine the practices behind marketing and selling powerful firearms like the one used in the attack.

“We can find out what the Remington defendants have tried every step of the way to block in discovery,” said David Wheeler, whose 6-year-old son, Ben, died at Sandy Hook, about the gun maker that was among the companies named in the lawsuit.

Joshua D. Koskoff, a lawyer for the families, described the discovery stage as “really the most important thing we’ve been waiting to do.”

REMINGTON GRANTED CASE STAY The Connecticut Supreme Court granted Remington Arms a stay in the Soto v. Bushmaster case as it appeals the decision to the U.S. Supreme Court. The state Supreme Court allowed the case to move ahead based on a narrow interpretation of Connecticut’s Unfair Trade Practices Act (CUTPA). Remington will not have to turn over discovery materials while the appeal is pending.

It is after all the Communist State of Connecticut, Right up there with Massh**eChusetts, New Jerky, New Yack and Commiefornia.
 
Goodbye Remington. Considering the 2 pictures of guns at the top of the page are of shotguns and not rifles, let alone ARs, I'm sure the next call will be to ban all shotguns.

Now, people can sue gun manufacturers out of business, tying up all of their funds in needless litigation. They won't be able to make payroll, pay rent/mortgage, upgrade machinery, devote time to R&D, and so much more. If Lanza's mother had a different AR, made by CMMG, Colt, or anyone else, then he would have used that gun. You can argue that the mom shouldn't have had a gun in the house if she knew her kid was such a whack-job. Sandy Hook was an absolute tragedy, but it wasn't the fault of the manufacturer.

The ripple effects that will be felt by the employees who will no longer spend money in their local communities, and those business that will see their bottom lime impacted, will be significant.
 
Let's hope the Court is placating the plaintiffs for now to show it cares, but will ultimately judge in Remington's favor. I did say, "Let's hope".
