Can a criminal driving offense force me to lose my LTC?

Monday night I was being followed by a LEO, who decided to run my plate. Apparently my car came up unregistered/uninsured. I didn't get arrested or have my license taken away on the spot, but he did tow my car. Today I have to go to the Ins. Co. and get that straightened out, then to the registry to re-register my car. I also need to find out if I have to appear in court for possible fining or worst case scenerio loss of license for up to 120 days. Could this affect my LTC even though it was a criminal moving violation?

Under "suitability", yes it can. Also next time around I think that hte question "ever appeared in court for a criminal matter" (or some such wording) must be answered affirmatively and again the issue of "suitability" is at the chief's discretion.

So it can affect your LTC, but it may not.

You can't be arrested for either of those infractions. Did you get a citation? If so, were you charged with both of those infractions more especially uninsured? Unregistered is civil and uninsured is criminal. If you were charged with uninsured, a box on the bottom above the signature should be checked as criminal application.
READ the back of the cite. You need to request a Clerk Magistrate's hearing. You have 4 days, READ FOUR DAYS to return that cite to the court who has jurisdiction. The address will be on the right bottom of the front. Hand carry it to the court. If you do nothing, a criminal complaint WILL issue and you'll receive a summons to be arraigned.
Get the car re-registered and insured ASAP and save any documentation for the hearing. You may want to contact an Attorney.
In some cases, I've seen the charges dismissed when the car was taken care of and the person had a clean record.

I got hit with an unregistered ticket last year. My mistake, with a new
baby I just spaced for a month. The magistrate was open to my
apology and once I furnished proof that I corrected the issue
immediately the whole issue was thrown out, with the support
of the State Police rep. Fix this right away and plead your case!

I got stopped for unregistered a while ago like in 1988. It was $100.00 ticket (maybe more now) and the towing and storage charge. Plus when I renewed my registration it was retro back for the three months prior. I didn't feel it was my fault as I never got the renewal notice in the mail. The state trooper really didn't care that I never got the renewal, but I can tell you that I know when every registration I have expires....now. That won't happen to me again.

The application (Form FA 25/26) that I have here says:
Have you ever appeared in any court as a defendant for any criminal offense (excluding non-criminal traffic offenses)?

So, if it's a criminal offense like your title suggests, then yes you have to list it and that makes your license discretionary. It's all in the hands of the chief, now, I suppose.

I didn't get charged with any citations. I went to the District Court and spoke to the Court Clerk. She told me that I have two options: 1: Ignore it and I'll get a summons to appear before a judgeand have a hearing, and whether the charges get waived or not, It will go on my criminal record, or 2: Sign and date the back and request a hearing with the magistrate. If he decides to waive the charges it will not show up on my record at all. Considering I reregistered and reinsured the car as quickly as possible, and I have a perfect driving record, she said there's a very good chance that the charges will be waived.

The "ticket" you got is the citation. So did you request the hearing? You should have done it right there as you were speaking with the clerk.

I did request the hearing. I signed and dated the back and gave it to her and she said I'll be getting a letter within 3 - 4 weeks with a time and date to speak to the magistrate.

A Trooper definitely won't care that you didn't get a renewal form, it's always the car owners responsibility to keep things current. I didn't get mailed a renewal application for my Class-A this last time around (like my brother did) and I certainly wasn't going to wait around for it.

I was going to say the same thing...

Ignorance of the law is no excuse...or whatever they are always saying.

They will tell you that getting that thing in the mail is just a courtesy, that it's your responsibilty for making sure that everything is in order.

I know, I've heard it before...with my insurance company. We moved, didn't get the bill that the year was up. I forgot when the end of my policy was. They did have my forwarding address as I got the message that my insurance was cancled.

So, I called that day, paid within my 10 days or whatever it was and was re-instated. But I did have to take time off to go and get my car re-inspected for the insurance company. Which is a joke because they just hand you the form and tell you to fill everything out. Then they take the pictures and you're on your way.

Quick update: When I spoke to the court clerk, she told me that if I waited to get the summons, that I'd have to appear in court before a judge, and whether it got dismissed or not I'd have a criminal record. However, by signing the back and requesting a hearing with the magistrate, if he dismisses it then it gets wiped clean. No record, like it never happened.

Good luck with that, good to keep in mind for the future, as well. Keep us posted.

Rapture,

Im in the same situation as you, would you put Yes on question 10 on your application?
I dont believe we were ever named as Defendents, since no criminal complaint was made.

INAL, but I think that's a criminal offense. Look it up.

You will still have an appearance on your CORI with a document number I think. The status will be dismissed or CWOT or something like that.
