CA - Man Shot & Killed After Driving Car Into House

A Clearlake man who drove his pickup into the home of a former employer and allegedly threatened to kill the man was shot and mortally wounded early Sunday.

Clearlake Police Sgt. Tim Hobbs' report on the incident explained that at 2 a.m. Sunday 67-year-old James Mitchell was asleep in his residence in the 14200 block of Olympic Drive when 51-year-old Kevin Quinn allegedly drove a 1994 Chevrolet Silverado pickup into the front of Mitchell's home.

Hobbs said Mitchell armed himself with a handgun and went to the area of his residence where he heard the crash. When Mitchell went into the room he reportedly was confronted by Quinn, who had gotten out of the pickup.

Quinn allegedly advanced toward Mitchell in a threatening manner while making threats to kill him, Hobbs said.

Mitchell attempted to flee his own residence, and as he was trying to get out of the house Quinn caught up to him, Hobbs said.....

Having been stated here and on other forums most people in a life threatening situation would prefer to try and avoid causing life threatening harm to another person. let's go over this,someone crashes their car/truck into your house,it's in the middle on night (? a.m.) and you've been woken up by a big crash. Your half asleep wondering what the hell? You grab a weapon and investigate and there's someone in your house threatening to do you serious bodily harm. He advances and you back up not wanting to have an altercation. Backed into a corner you take the only option left lethal force. I can understand why he tried to leave but can't find the words to explain it.

When someone drives a car into your house and threatens to kill you or harm you, you already ARE in the middle of an altercation.

End it immediately to your favor.
 
Amen Jose! I totally agree with you. A home owner should – no, MUST - have the right to defend his or her own castle and belongings without having to retreat, abandon his or her possessions and without placing themselves or and their family in greater danger in the name of the criminal justice system.

Why do so many people feel it appropriate, and even mandatory, to vacate one’s private property in the name of a frigging violent criminal? I believe that when criminals violate the sanctuary of one’s home, they ought to be met with appropriate force… and that is with ALL the force the homeowner has. No holes barred. No stupid liberal laws. Violate a private residence and your put your health, wellbeing and life into the hands and discretion of that homeowner.
 
It's CA, he was probably just making a CYA statement.

IIRC CA has halfway decent laws WRT deadly force while inside ones home. For all the communism in that state, that's one thing they didn't completely destroy yet. I don't believe CA has a "must retreat" clause.
