Buying AR's in another state

Since you can, by Federal Law, purchase rifles and shotguns in states other than your own, might you Mass. guys buy an AR, AK etc. in others states? My understanding of the new AW ban is that it's only sales IN Mass. that's is banned. If my understanding is correct there are many shops in VT., N.H. that would welcome the business.

I'm sure in the past I've made jest of you Mass. residents but now you have only heartfelt sympathies.
 
It may be 100% legal, but it will be tough to convince an FFL to sell to a MA resident right now. Federal law says that they can sell rifles that are legal in the home state of the buyer. The law says it's legal, but the AG says it's not.

And then the buyer would need to eFA-10 it when he gets home, which will flag him as a felon.
 
The sale, delivery, and receipt of the rifle or shotgun has to fully comply with the legal conditions of sale in both states. See 27 CFR 478.96(c).

AYFKM? Why the hell, after this debacle, would you EVER fill out an FA-10 for any gun purchase ever again????

I thought we were talking about what was legal, not what a sane person would do.

FYI - I left MA for good last Saturday. I brought with me 6 ARs, including a pistol, mostly built on 80%'s, 7 AKs, all home built with folding stocks, and not a damn one of these ever had an FA-10 filed.

I'd tell Maura to suck it, but I know she doesn't go that way.

That's not what I read her notice as. We are all felons unless we have a true pre-ban, she just isnt planning to prosecute anyone. For now.

Additionally, because these can no longer be sold in MA, you and an out of state FFL would be committing a crime by you buying it from them.

No, they are not legal in MA as long as they are MA compliant. The AG specifically stated that there is no such thing as a compliant firearm in this state. You can talk about and hope for loopholes all you want, but she got away with reinterpreting the law to fit her agenda and it is going to stand in this state. The legislature here DGAF about guns. The courts are rigged. The governor is a socialist masquerading as a Republican. We can file a lawsuit, but I would say the odds of this ever being overturned are about 5-10%. I would love to be wrong, but I don't think I am.

The issue here isn't that the AG is going to be "threatening" people. The issue is that she can and will be arresting people for crap like this. When it gets to a MA court, the judge will say "well, you should have obeyed the law." The AG essentially has unlimited funds to wear people down. You can hire a few lawyers to fight for you, but can you spend millions on a case that would likely end in a felony conviction and quite possibly jail time anyhow? I sincerely doubt most people here can.
 
Buy them anywhere you can find them. You will be called upon someday...soon.

My understanding is that the AG reinterpreted the law to make anything similar to an AR (usage of interchangeable parts, copies, duplicates, etc) illegal. There's no crippling it; there's no modification that circumvents the law. Can you get one out of state? Sure. Is it legal? Definitely not according to the AGs current stance and the general understanding at this moment.
 
The issue here isn't that the AG is going to be "threatening" people. The issue is that she can and will be arresting people for crap like this. When it gets to a MA court, the judge will say "well, you should have obeyed the law."

Whether this happens will depend upon the every day common gun owner. She has started what will be a long term clamping down on gun confiscation. She knows there would be mass carnage if she started right off with confiscation, so it will slowly ramp up to a mandatory turn in for these firearms. If gun owners comply, she has won. If though MA gun owners tell the AG to "F" off like the CT gun owners did, then we have a chance. She doesn't want to send police to 10s of thousands of peoples homes and in talking with a few police friends, they want nothing to do with home to home confiscation. This is in it's early stages, but gun owners need to stick together and not cave in. If that happens there's a chance. If we start to cave, it's all over.

I'm guessing your idea of "sticking together" = crapping on gun store owner via email?
 
Interchangeable of WHAT part???

I can buy a Mossberg pump shotgun with an AR-style stock. Assault weapon???

Anything that takes magazines that have been around for at least 22 years is now an assault weapon???

The reverse: I can get a piston upper'd AR. The upper parts, outside of the bbl, are not interchangeable.

Maybe get someone to make MA AR lowers - re-engineer the LPG to fit a different way that is not compatible with a pre-94 Colt/Bushy/Whatever. LOL Heck, get someone to make a trigger group that uses a different set of holes, create a jig accordingly and she'd be SOL. . . . or would decide that it really IS based on looks.

It will get very interesting very fast if she actually starts arresting people under her new law "interpretation" that says we are all felons... thousands upon thousands of us. Truthfully, if she is that bold or just plain stupid, I say the sooner the better. Bring it on crazy b****.
