The 80% designation refers to a lower that is 80% complete. It is not saying that the lower by itself is 80% of a firearm. 80% lowers for AR-15s for example don't have trigger pockets or pin holes.

It talks about readily convertible and when speaking in the context of a receiver or frame alone they are saying that omitting agreed upon features is still sufficient however when you start to include other parts it makes it "readily convertible." I don't agree with this because its a slippery slope in more ways than you guys think from the perspective of an OEM.

State and Federal agencies have wiggle room for how the laws are applied, but when they go beyond the letter of the law, the court needs to step in and smack them down, like SCOTUS did to Maura in Caetano v. Massachusetts

not regulations but adding "clarity" to existing definitions. In their eyes they are just clarifying the definition of SBR's.
 
Yeah - I'm not sure how they got there. I honestly don't see how the "Buy, Build, Shoot" kit can be declared as a firearm. The lower in that kit is an 80% lower. Yet somehow the bundling of it with the upper and lpk makes it a firearm? That's just not consistent with their earlier statements and actions.

Starting to wonder if they're actually going to be able to get AR15s declared as NFA items.

The catch is that this isn’t grounded in law. The frame is the firearm. They are over reaching but this isn’t a lock for us in court. Or could lewd to an update of laws in Congress. This is what we should be worried about.

its not a percentage that they go by or even a feature set. They are looking to see it it can be "readily converted into a firearm" and that was the threshold so they think that shipping with the parts makes it a firearm.
