BIG WIN! Judge Says Ghost Gun Ban Is Unconstitutional!

Great decision but wishful thinking as far as Ma. rights are concerned. As long as a D is in the WH they will use their legal or illegal power to target gun laws, manufacturers and gun owners

Story here:

Note that the judge granted a preliminary injunction barring enforcement, so it now goes to trial.

Seems like a good call though:

“The judge wrote that without an injunction, the plaintiffs would “face irreparable harm ... because they are threatened by criminal penalties should they engage in conduct protected by the Second Amendment.”

How many pre 1968 guns have serial numbers?
What about pre 1900?
Nothing in the text, tradition or history of the United States required serialization of arms - they may find a few examples but the tradition was that there was no requirement to track arms outside those directly in the governments control.

We just need to move good cases through the system. The issues will come from overzealous people bringing poorly written suits with non-sympathetic plaintiffs.

Our Constitution was written in the 1700s. Back then, everything in the Colonies was handcrafted, including firearms. Those Pennsylvania rifles that Colonial marksmen used to great effect against British soldiers armed with smooth bore muskets would prove this. Pathan tribesmen in the Khyber Pass have been doing the same for centuries. Homemade guns are very old news.

Concur - history and tradition absolutely are on our side. Zero support in history for banning homemade firearms.

Hmmm… 692 Ghost Guns recovered from 45,240 homicide and attempted homicide investigations - that’s 1.5%. And that’s what ATF is targeting rather than the 98.5% of serialized guns used in such violent crimes? That would be a grave misuse of resources - again…

“George Washington, in order to reduce the number of army-issued guns his soldiers would take home and attempt to keep, had all Continental Army firearms stamped with an insignia, starting in 1776, to mark them as public property, though apparently this did not solve the theft problem completely. The marking was alphanumeric: “U.S.XIII,” and though it did not assign a unique serial number to each firearm, the marking served the same purpose as serial numbers today – it allowed the government to identify guns and their source to help enforce antitheft and other laws (such as the prohibition on selling guns to the enemy).”

Very weak arguement…

The Continental Army was the regular military, not “The People”, which included militias, although militias did serve along side regulars.
