Another Transfer Question......

Having read the stickies, I have been unable to find the answer to these questions / scenario's.

1. When did the FA 10 come into existance?

2. How does one transfer / register a firearm that was given to them by someone unrelated to them, while they were living of course, who has subsequently passed away over 15 - 20 years ago or more. The deceased was licensed, as was the receipient, on the old "blue card" during the gift exchange.

3. During this time while the person was alive and gave the gift, was there suppose to be any paperwork filed and if so, what was the form called?

This scenario has presented itself a few times while taking care of hospice patients. Each time, not knowing the correct answer, I have referred them to their local police departments.
 
  1. The current FA-10 replaced the old blue cards in 1998.
  2. The way in which one obtained a firearm makes no difference in how one transfers it (C&R acquisitions aside). If both parties are licensed residents (and the 4/yr limit hasn't been reached), transfer via FA-10, otherwise through an FFL.
  3. Yes, if done in Massachusetts. FA-10 or blue card. Lack of copies of such documentation has no impact on the transfer. The state itself has no records of transfers prior to 1998.
 
Question 2.- If you took legal title ( by gift or otherwise), say 20 years ago. Then you can possess ( assuming you are properly licensed today) the firearm in question and are not required to file anything today. The current law is required to record "transfers". It is not a "registration" law.

If you are talking about transferring this firearm to someone new then the FA-10 or FFL route is required.
