.... Federal agents are investigating after a fisherman on a Virginia-based fishing vessel was killed by another crew member armed with a knife and a hammer, officials said.

Franklin Freddy Meave Vazquez, 27, a Mexican national, is accused of attacking three crew members while their vessel, Captain Billy Haver, was sailing approximately 55 miles off the coast of Nantucket. Vazquez faces one count of murder and one count of attempted murder....

.... According to a criminal complaint, Vazquez is in the United States illegally. He was also arrested in Newport News, Virginia in March for abduction, the document said. Vazquez was released from the custody of U.S. Immigration and Customs Enforcement on April 23.
 
Mexican national in the US illegally....

Arrested for abduction in March before assaulting 3 on the fishing boat. Makes me wonder what crimes he was fleeing from in Mexico.

Maritime law typically regards a vessel as part of the territory of the country that flags the vessel, and the ship's captain as its highest authority, until the ship docks.
Many national laws also include this as a description of part of their territory.
Further, national laws in force according to the vessel's flag also determine how laws are applied and how crimes are prosecuted, giving more or less free rein to the ship's captain. Hence, while some countries will usually require the ship captain to restrain the offender until the ship docks, others allow the captain to arrest and even execute travelers in certain cases.

I wonder what the number of illegal alien on American crimes has to reach before they're all rounded up and sent back where they came from? I guess we haven't reached that number yet because they're still prowling around the country committing crimes and nothing is being done about it.
 
In the article it says he was arrested in Virginia back in March and then released by US immigration and Customs Enforcement on April 23rd. Looks like they had him once before.

So in theory, could the captain detain him, go out beyond the 200m, shoot him in the head and throw him overboard, and this wouldn't be a crime? Or does the US extend it's territory to include ships flagged under the US?

No. And yes.
Also, don’t get too hung up on the EEZ - that’s for natural resources. (Fish, minerals, oil, etc), and in fact is not always 200nm from the baseline.
 
I shoot breaking news video from one of the news helicopters and got to cover their boat coming into the harbor. Guys on deck were all smiles like nothing had happened. Waved to the helicopter. Captain said something and they moved inside.
