On the Chelmsford police FB page they said last night in Chelmsford a Bronco was stolen out of someone's driveway. The Bronco was recovered in Dracut but the car had two firearms stored in a back pack inside. One of the firearms is now missing. The owner was honest with the police and reported everything. Is he screwed?
I can’t answer this from a legality perspective, but stop arming bad guys by leaving shit where it can be easily stolen!!

Yeah I might have been quick to use bolt cutters on a lock box and leave the cable attached to the seat frame……Shame I lost my guns….

I know that the answer doesn't matter from a legal perspective, but from a logical one it matters.
As far as any possible gun charges are concerned it won't matter to the authorities if the car was locked or not.

I get your point though, an unlocked car is easier to steal and/or steal from than a locked car.

My point was, can (we know it doesn't)/should the car qualify as a locked container.

Edit: more precisely; an unoccupied locked car.
 
I've been told that a locked vehicle IS a locked container and I've been told that it ISN'T so I don't know which is correct but I'd say he's screwed.

If he was smart, he would have allowed a lawyer to do all the talking.

The second he noticed the stolen truck, first call should be to a lawyer. Second to the PoPo to let them know the truck is missing. Or maybe forget the PoPo and go back to sleep.

He is if the firearms were not in a securely locked container (and according to EOPS a locked trunk counts as secure storage).
