You know what REALLY pisses me off about this? I mean, aside from the fact that YET AGAIN Massachusetts coddles a dangerous criminal?
If I were to be found to possess a post-ban "high-capacity" magazine, I'd go to jail for a year and a half longer than this cretin.
That's MA justice for you.
Rape a small, defenseless child? 3.5 years.
Possess a piece of metal? 5 years.

i've said it before, and i'll say it again. a society that does not swiftly dole out justice commensurate to the crime committed will never remain free. otherwise you continue to have what we have now, a large group of potential victims continually preyed upon by predators. predators who fear neither societal breakdown, nor societal punishments.

I agree with you. Its tragic that daddy on the outside can't take care of business like the thugs on the inside. Probably why we have this cycle going on in the first place.
I'm not an internet tough guy, but I am unsure if I would be able to show any restraint if I found someone molesting my kid...or any other kid. A situation I hope never to be in for everyones sake.

there was a situation here in NH a couple of years ago where a 24 year old male day care assistant was caught, and confessed to molesting children in his charge. he also happened to be very active in a church youth group supervising some of the younger children. my children were in CCD classes he'd supervised. nothing ever happened to them, but it's an interesting array of emotions you go through in a very short period of time. to say the least.

Many times the Prosecution and defense have not agreed to a plea and they go before the judge "unagreed upon" and leave it up to the judge. Everyone has the right to plea their case out without going to trial. The prosecutor may have had a very good case and asked for a very lengthy prison term and the judge made a more lenient finding.
The other thing to remember is that this guy cannot be convicted at trial without the testimony of the victim/child. Putting a child victim on the witness stand is a very risky proposition as you have no idea how they are going to handle it. It is also sometimes very traumatic for the child as it makes them relive the event which they may now be on the road to recovering from.
Sometimes it is better for the child to have the case plead out sparing them from the testimony.
Do not read too much into it without knowing the facts of this individual case.
I bet they cut a deal so that the kid wouldn't have to testify, and 3-1/2 years was the best the DA could negotiate.
If it was my kid, I'd do everything I could to ensure that the perp did no jail time.
