Default Rights of elderly condo owner

    Hi all,

My MIL is nearing 90 and in decent health, but does have breathing problems. During the really hot and humid weather she was in distress and her doctor suggested an air conditioner for one room in her condo to help her breath without discomfort.

Well she's learned that the condo association has rules against a window air conditioner and they turned a deaf ear to her medical needs. Her doctor offered to write a letter on her behalf but the condo association said it won't matter.

I'm just wondering if the condo association is within their rights to ignore her medical needs. The condo docs are very clear, but are there any protections or remedies in law for this type of situation?

    Thanks,

    Rich

I have a stand alone in my office that works pretty well, it's about the size of a dehumidifier. I'll get som info on it tomorrow.

Great ideas on the floor standing A/C units. I'll ask my MIL to see if that will satisfy the powers that be.

If she can't stay there because of the lack of good AC, she may have to move and rent the place out.

I got in a beef with my condo board once, I told them I would rent the place out to a level 3 sex offender for a dollar a month if they insisted on screwing with me. I got my way.

I'm hoping they will allow her a medically necessary device, but if not there is always plan B

Having dealt with power hungry, myopic condo associations before I know they can be tough to deal with. I really don't want to get into a pissing match, but if my MIL does have legal rights I'm up for the task of fighting on her behalf. She's a nice old lady and has a right to breath.

Oh, I know... Dealt with it too. My solution was to a. Use their own stupidity against them and b. GTFO as soon as I could and carefully scrutinize all deed restrictions into which I entered since then.
