The festivities of the annual celebration of our nation's independence at Lake Murray will be a lot less festive this year, as the Lake Murray July 4th Music Fest and Fireworks Committee has decided to cancel the fireworks display and music fest.
Committee chair John Pilch, in an email to La Mesa-Mount Helix Patch, said that because of a threat of litigation by the Coastal Environmental Rights Foundation (CERF), the popular event will not happen this year.
"Marco Gonzalez (CERF lead attorney) prevailed in lawsuits No. 3 and 4, due to the City of San Diego not completing a Program Environmental Impact Report (EIR) as they reported they were working on last August. The three-member Lake Murray Music Fest and Fireworks committee did not wish to deal with personal liability exposure and the costs of litigation and decided to cancel the event this year," Pilch wrote.

Gonzalez, an environmental attorney, is a staunch opponent of fireworks displays over bodies of water, claiming that they can have harmful ecological effects on the water, and that further evaluation is needed. As Pilch noted, last week, Gonzalez and CERF won two lawsuits against the City of San Diego, because of the city's failure to properly complete an EIR about fireworks shows

Fire chiefs, water superintendents, and local elected officials can use several best management
practices to minimize the likelihood that fireworks will contaminate drinking water supplies. These
practices include prohibiting or minimizing the use of fireworks in areas where perchlorate could
easily contaminate ground and surface drinking water supplies. To assist local officials, DES can
provide maps of wellhead and source water protection areas for community water supplies.
Alternatively, fireworks that do not contain perchlorate could be used. However, DES understands that
most fireworks used are imported from outside the United States and that it is very difficult to verify
the composition of fireworks that are obtained from foreign countries. Other best management
practices include quickly removing firework “shells” or wrappings from the environment after blasting
off fireworks, and removing the physical residue from blasting devices before the perchlorate is able to

Going to have to hunt down the report, but WBZ News was talking about a town in NY that has cancelled their fireworks display because last year a pair of baby bald eagles [STRIKE]fell out of a[/STRIKE] left their nest and it's suspected they may have been startled by fireworks.

The Times-Herald Record of Middletown reports that last year, some baby eagles left their nest, possibly startled by the pyrotechnics.
Now, the U.S. Fish and Wildlife Department says the fire department could be liable for thousands of dollars in fines if eagles are harmed.
