    SPRING VALLEY, Calif. -- An investigation was under way Monday into a deputy-involved shooting in which a Spring Valley woman was shot by a deputy who was checking her backyard for a masked man.

    Gore said the deputies thought Orey's open gate looked suspicious, so they went into her backyard. The deputies ran into Orey, and one of them had a "spontaneous reaction."

    That sounds so casual, like it happens all the time.

    So an open gate on private property is enough probable cause or reasonable suspicious for a cop to meander his way onto the property without owner consent?

    EDIT: I missed the part where he was looking for a masked man. But the home owner identified herself as the homeowner and was shot. Awesome job.

    What is this country coming too! She was in her own backyard, cop comes in and she startles him with a pair of pruning shears, sure it was 10 at night but something is fishy about that. So maybe next time she should drop anything in her hands, then dive face first into the ground to show the porkchops her submissiveness.

    I really think its time to move back to Indiana, think this just might come in handy!

    Based on what I have just read, it appears that the sheriff used the term, "spontaneous reaction", If that be the case this is a training issue or lack thereof. This why as a Training Officer, I was overbearing about officers keeping the index finger along the slide or frame until it needed to be on the trigger. There is such a thing as a startle reflex or sympathetic reflex. THESE ARE TRAINING ISSUES, I MAKE NO EXCUSE FOR THIS.

    This is gonna get expensive. How can the victim NOT sue and win?

    If I was a taxpayer in that county, I'd be pissed off to know my taxes were going to pay for these deputies' stupidity.

    Also the Sheriff was covering up the fact that the homeowner was shot in the chest, stating that the officer shot the woman in the arm.

    Could be possible that it went through the arm and entered the chest after?
