    A really frightening ruling from the SJC.

    Ok, so the SJC ruled that IRAs and the like must be liquidated before one gets a public defender - not unexpected. Anyone facing serious charges would probably prefer destitution to relying on the mercy of a randomly assigned, unseasoned, $30/hour attorney.

    BUT.... it also ruled that the assets of parents and romantic associates living in the same house count. What was not apparently covered, is what happens if a parent or girlfriend with no legal obligation to pay for the legal fees of another adult refuses and the party goes pro-se. It would seem that the SJC is stating that there is either an obligation to pay for another adult's legal fees, or no right to counsel unless one's relatives or romantic partner agrees to pay. The right case would make an interesting federal challenge.

    This is definitely going to become a real issue as adult children continue to live with their parents until age 40 or so.

    Last I heard, someone charged with a crime was an innocent person until actually convicted in a court of law. Right to counsel is an important safeguard in a free society.

    WHAT!!!!????? WTF? I hope you misread that ruling (but I doubt you did) First Roberts now this shit. What the hell is going on with our court system? This place needs an enema.

    Article I found mentioned something about the "disposable" income of parents and living partners at the same address where the defendant lives; if that defendant contributes a "substantial" amount toward household expenses.

    Indeed. It destroys the victim's ability to distinquish irony, figures of speech, metaphor, similes, jargon, and humor; leaving him prey to the unquestioned certainty that every statement he hears is to be taken literally and seriously.
