    Default ABDW can they own a gun?

    Not sure if this is the right forum, I have a friend who was charged with assault and battery with a deadly weapon(not a gun) when he was younger and did 30 days in prison. Is it worth trying to get a license in ma?

    A guy that I work with got arrested about 10years ago for domestic abuse and while they were taking him away yelled "I'll kill you" to his wife in front of 2 cops. He tried applying for his LTC a few years later and couldn't understand why they wouldn't give it to him, some people are truly dopes!

    Anyone convicted of a "violent crime" is statutorily prohibited for life!

    Yes ABDW (even with an unshod foot) is under MGL considered a "violent crime"!

    If said individual was never convicted, he could has been under the misconception that he was entitled to due process, and could only be punished via deprivation of a constitutional right after conviction, a guilty plea, or when charges were still pending (which is how things are handled in the shall issue states).

    Nope, sorry.

    ADW in MA is both a violent crime, and punishable by up to 5 years incarceration.

    As such, a conviction is a statutory lifetime prohibition on both a State and Federal level.

    It's my understanding that with that type of conviction, he's done (prohibited), in all states and federally, for life. (Barring a pardon/rehabilitation (?) of his rights.)

    "Charged" and denied bail (hence "prison" time)? Or "convicted"?
